Well. to be honest...if it was me, I would contiunally contact my buyer to make sure he had gotten them...thats just good business and good sense and courtsey.

Its a bad situation all around, but the only person that is blantantly wronged is TMarcumUSN...he has no product that he purchased and he's still out of the money...while you have the money. So, you got to view it from his point of view...all he has is what things appear to be, and with just conjecture from your end and the facts on TMarcum's side...

And I have a newborn that is jaundiced and Im not being any different from being sleep deprived...but I do feel your pain!

I dont see where I assaulted you. I see where I posted a clear explanation and plausible reason why the package is not here.

You said it's stupid that someone would go back and get the package- I agree! It is stupid- but it has happened, and I'm sorry, but it seems like one of the possibiltiies here. Especially seeing you shipped it the identical method the other guy did, and his had continuing updates (sorting sites and what not) as opposed to yours, as it was just "accepted." The Post Master herself said it should have at least ONE sorting facility posted, and the only two reasons why it wouldn't is someone didn't scan it as they're suppose to at the sorting facility, or the sender came back and got the package. I'm not saying you did this- I'm saying its a very real, very clear plausible reason as to why it isn't here.

Like I said, I want a happy resolution for this. The USPS claim can very well take just as long to come back, and by that time I'm headed to Iraq, and I will not be able to properly handle this.

I'm sorry you feel assaulted, but in my opinion a innocent person rarely feels assaulted when accused of something they know they have no fault in.

I can accept that, but I can't get you your money before I get it back from USPS. Not trying to make a bad situation worse, just the true. I am in the middle of filing the claim.

PLEASE STOP ASSAULTING ME. You asked me to post the scans I did. You now have posted a claim and I will be filing a claim with the post office tomorrow morning. I never heard back from you to go ahead so I didn't.

Why would I take the packages back. Its absurd, come someone please tell me that is just a little stupid. I don't know why it hasn't said anything else, I don't know why its not there. I do know that now I'm being publicly humiliated, no one seems to think I did anything right and I kept providing evidence that I have done everything I could to prove A. I shipped it, B. I had tracking for it, and C. It was insured.

The last email I got from you was on June 30 except for the email notification from Paypal tonight. I have received nothing else.

The reason this was made public was because you're usual response (paraphrasing) is "I have no control, it gets there when it gets there, its on its way" but surely you see where I think the worst has happened. The questions I have to ask is...

1. Where is the package? (DC # says accepted)
2. Why does this package have the same tracking/shipping method as the other, but the other had regular updates and was shipped AFTER this one, and yet I still got it first?
3. The Post Master gave me a very plausible explanation of what could have happened, should I cover all my bases?

Logic said to answer "yes, ASAP" the question #3.

I have to file the claim at the post office tomorrow morning. I tried filling it online however their system said I need to do it at a post office. Here is a screen shot of that message:



I will file out the Claim Form 1000, I will scan it and post it one this thread and then I will submit it. After I submit I post that I have and if any proof is given to me at the post office that the claim as been submitted, never had to do this before through USPS, I will also post this on this thread to show proof that it is moving forward.

Any further correspondence to either me or the buyer or from USPS I will post on here so that there is a clear track of what is going on.

Honestly thats fine, but could a Site Admin please look at my PMs. The last PM I received from you was tonight saying that you filed a Paypal Claim. Not saying you didn't send me a PM, I just want an Admin on this site to confirm that is the only one I had when I logged on tonight.

Other than the PM tonight about the Paypal Claim, the last PM I got was on June 23rd.

TMarcumUSN can you check your gmail account, I sent you an email a little while ago. Can you confirm that you got it and if so can you reply just saying you got and then post on here that you sent it and then I will check to see if I received it.

If there is nothing else I am going to bed, its almost 12:45 here. I will be online for another 15 minutes if no one else has responded I will log on tomorrow and post the progress of filling the insurance claim.

Here is the customs form. I apologize about the quality but this is the carbon copy of it. I have "painted" over my signature for obvious security reason.



Here is where this gets screwed up. I can not file a claim for lost mail for Surface Insured Mail to a APO/FPO box till 75 Days after the mailing date which would be August 9, 2009. Here is the link to USPS website stating that:

I have also attached the link to the Insurance Claim Form 1000 in PDF. If you scroll to the bottom it also says that Lost Articles shipped to Insured APO/FPO surface mail can not be submitted for a claim before 75 days after mailing date.

At this point I don't know what I can do. If I return the money and then the comics get there before August 9, 2009, I am out of the comics and the money and I can't file a claim as it would be delivered.

I doubt TMarcumUSN wants to wait till August 9 so I really have no idea what to do. Can anyone give me some advice.

I've already waited almost six weeks when other packages shipped the same method with the same tracking (with a lot more information on it) have gotten here already, and it was shipped after he sent his, from the same area.

Out of curiously how big were the other packages? The one I sent was 30 pounds, about 36 x 16 x 12 or something similar to that.

I just got back from the post office I shipped the comics from. The Deliver Confirmation is literally just that for Media Mail. It will confirm once the package has been delivered. No other information is provided. We have to wait 75 days for the package to not be received before an insurance claim can be filed since it was mailed to a APO/FPO. That is what the person at the counter just told me.
